1. Contractual Relationship
These Terms of Service ("Terms") govern your access to and use of the mobile applications, websites, and integrated services provided by Squinted Ltd ("Squinted", "we", "our", or "us"), a company registered in the United Kingdom. By creating an account or accessing our platform, you agree to be bound entirely by these Terms. If you do not agree to these terms, you may not access or use the platform.
2. Nature of Our Services
Squinted operates an online peer-to-peer re-commerce marketplace enabling users in the United Kingdom to list, sell, browse, and purchase pre-owned spectacles, sunglasses, and eyewear accessories.
You explicitly acknowledge and agree that Squinted Ltd is not a party to any transaction concluded between buyers and sellers on the platform. Squinted does not act as an optical laboratory, an optician, a manufacturer, or a commercial retailer. We provide the marketplace infrastructure; the underlying contract for sale is formed directly between the buyer and the seller. Consequently, Squinted has no control over and does not guarantee the quality, safety, accuracy, fit, suitability, or legality of any items listed.
3. User Eligibility and Onboarding
To use the platform, you must create a registered profile and complete our verification onboarding process. By registering an account, you declare that:
- You are at least 18 years of age and possess the legal capacity to enter into binding contracts.
- You reside within the United Kingdom and intend to use the platform solely for domestic UK shipments.
- All registration profile details, identity parameters, and contact references supplied during onboarding are strictly true and accurate.
- You will maintain the security of your login credentials and assume absolute liability for all activities occurring under your account.
4. Listing Guidelines & Seller Obligations
When listing eyewear on Squinted, sellers must adhere to strict platform standards to preserve community trust and catalog integrity:
- Accuracy: Listings must feature actual photograph representations taken by the seller and must accurately detail the physical item condition, dimensions, brand markings, and any structural wear or defects.
- Counterfeit Prohibition: The listing or sale of replica, counterfeit, unauthentic, or grey-market designer eyewear is strictly illegal and fundamentally prohibited on our network. Violations will result in permanent profile suspension.
- Prohibited Items: Sellers may only list authentic frames, lifestyle sunglasses, and structural cases. You may not list prescription lenses separate from frames, medical diagnostic tools, contact lenses, or any item requiring a controlled professional prescription dispense under UK medical frameworks.
5. Financial Management & Integrated Payments
Payment processing services on the Squinted marketplace are handled exclusively by third-party vendor providers via Stripe Connect.
By utilizing our checkout or payout mechanisms, you agree to comply with the Stripe Connected Account Agreement and the Stripe Terms of Service. Funds processed for a transaction are held in a secure staging capacity and are disbursed to the seller's verified bank account only upon confirmation that the underlying item has been successfully delivered and accepted by the buyer, or upon expiration of the administrative verification window as outlined in our Buyer Protection Policy. Squinted reserves the right to charge structural platform commission or administrative transaction processing fees, which are clearly detailed to users prior to final checkout authorization.
6. Limitation of Liability & Platform Dismissal
To the maximum extent permitted by applicable United Kingdom law, Squinted Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data corruption, goodwill impairment, or physical disputes arising out of or connected to transactions executed between users.
We reserve the absolute unilateral authority to temporarily freeze, restrict, or permanently terminate user account access at our total discretion, without notice or legal liability, if we determine a user has breached these Terms, engaged in fraudulent activity, or diminished the safety of our peer-to-peer environment.
7. Jurisdiction and Governing Law
These Terms, their core framework interpretation, and any non-contractual claims or operational disputes arising out of or in connection with them shall be governed exclusively by and construed in accordance with the laws of England and Wales. The courts of the United Kingdom shall retain exclusive judicial jurisdiction over any legal actions.
